Terms of Service

1. Who we are

2. The Service

THELEADS.APP is a SaaS tool that lets users (a) extract publicly listed business information from Google Maps based on keyword and location, (b) filter and deduplicate the resulting datasets, and (c) send AI-assisted cold email outreach. The Service is provided "as is" and may be updated, modified, or discontinued at any time.

3. Eligibility & account

  • You must be at least 18 years old and able to enter into a binding contract.
  • You must provide accurate registration information and keep it up to date.
  • You are responsible for all activity under your account and for keeping your credentials secure.

4. Acceptable use

You agree not to use the Service to:

  • send spam, deceptive, abusive, harassing, or unlawful messages;
  • contact recipients who have opted out, or violate CAN-SPAM, GDPR, ePrivacy, or any other applicable law;
  • scrape, sell, or republish data in violation of Google's Terms of Service or third-party rights;
  • misrepresent your identity or use false sender information;
  • reverse-engineer, copy, or resell the Service;
  • overload, probe, or attempt to bypass rate limits or security controls.

You are solely responsible for the content of your outreach and for compliance with all laws applicable to your campaigns. We may suspend or terminate accounts that violate this section without notice.

5. Subscriptions, billing & refunds

Paid plans are billed in advance on a recurring basis. Prices are listed on the Service and may change with 30 days' notice. You may cancel at any time; cancellation takes effect at the end of the current billing period. Except where required by mandatory consumer law, fees are non-refundable.

Consumers in the EU acknowledge that performance of the Service starts immediately after order confirmation and expressly waive their right of withdrawal under Directive 2011/83/EU once usage begins.

6. Your data, our data

You retain all rights to data you upload or generate ("Customer Data"). You grant us a non-exclusive, worldwide license to host, process, and display Customer Data solely to operate the Service. We retain all rights in the Service itself, including software, design, and trademarks.

7. AI features

Some features generate text using third-party AI models. Output is probabilistic and may contain inaccuracies. You are responsible for reviewing AI-generated content before sending it.

8. Third-party services

The Service integrates with third parties (e.g., Google Maps, email-sending providers, payment processors). Your use of those services is governed by their own terms. We are not responsible for third-party outages, data loss, or policy changes.

9. Warranty disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the event. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data.

11. Indemnification

You will indemnify and hold harmless the Operator from any third-party claim arising out of (a) your use of the Service, (b) Customer Data, or (c) your violation of these Terms or any law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your account for material breach of these Terms or for legal reasons. Sections that by their nature should survive termination will survive.

13. Changes

We may update these Terms. Material changes will be announced via the Service or by email at least 14 days before they take effect.

14. Governing law

These Terms are governed by the laws of [Country / Czech Republic], excluding conflict-of-laws rules. Disputes will be resolved by the competent courts of that jurisdiction, without prejudice to mandatory consumer protection rules in your country of residence.
